1. About JTC and acceptance of these terms
JTC.lk is operated by Joher Trading Company in Sri Lanka. By using the website or submitting an order, you agree to these Terms and Conditions, the Refund and Cancellation Policy and the Privacy Policy.
If you place an order for a company or other organisation, you confirm that you are authorised to act for it. Nothing in these terms excludes or limits a right or remedy that cannot lawfully be excluded.
2. Product information
JTC takes reasonable care to present product descriptions, specifications, dimensions, colours, photographs, stock information and prices accurately. Images are illustrative, screen colours may vary, packaging may change, and reasonable manufacturing tolerances may apply.
Confirm critical dimensions, load requirements, compatibility, colour, material, intended use and availability with JTC before ordering. Customers are responsible for choosing a product suitable for their intended application and for following applicable assembly, installation, loading, maintenance and safety instructions.
3. Prices and quotations
Website prices are stated in Sri Lankan Rupees unless shown otherwise. Delivery, transport, installation, assembly and other order-specific charges are displayed at checkout or confirmed separately where applicable.
JTC may change website prices and promotions before an order is accepted. A quotation is valid only for the period stated in it and may be subject to stock, supplier pricing, exchange-rate movement, quantities and written project terms.
If a material pricing or description error is identified after an order is submitted, JTC will contact you for instructions or cancel the affected item and refund any amount captured for it. JTC will not substitute a materially different product without your agreement.
4. Orders and acceptance
Submitting an order is an offer to buy the selected goods. An automated acknowledgement confirms that JTC received the request; it does not guarantee acceptance, stock allocation or dispatch.
JTC may verify product availability, price, delivery location, contact information and payment before accepting an order. JTC may refuse or cancel an order for unavailable stock, a material error, suspected fraud or misuse, a payment problem, delivery restrictions, quantity limitations, or another reasonable operational or legal reason.
An order is accepted when JTC confirms it for fulfilment and receives cleared payment where prepayment is required. For bulk, project, customised or specially sourced goods, a signed quotation, deposit or written purchase-order acceptance may form the contract.
5. Payment
You must use a payment method that you are authorised to use and provide accurate billing information. Available methods and any eligibility conditions are shown at checkout or on the relevant quotation.
Online card payments are processed by a secure third-party payment gateway. JTC does not store complete card numbers or CVV codes on its own servers. Payment may be subject to checks by JTC, the payment gateway, the card network and the issuing bank.
Orders requiring prepayment are dispatched only after cleared funds are received. Eligible cash-on-delivery orders must be paid as instructed at delivery. JTC may withhold dispatch or collection while an amount is unpaid or payment cannot be verified.
6. Availability and partial fulfilment
Stock indicators are not a guarantee and may change before an order is accepted. If part of an order is unavailable, JTC will contact you about waiting, replacing the item with your approval, dispatching available items separately, or cancelling the unavailable item and refunding the related captured amount.
7. Delivery and collection
Delivery estimates are provided in good faith and are not guaranteed deadlines unless JTC expressly agrees otherwise in writing. Timing may be affected by stock, payment clearance, route planning, courier or transporter operations, weather, access restrictions, public holidays and events outside reasonable control.
You must provide a complete address, reachable telephone number, suitable access and an authorised recipient. Additional charges caused by an incorrect address, failed delivery, restricted access, special handling or redelivery may be payable by the customer where disclosed and reasonably incurred.
For branch collection, wait for JTC to confirm that the order is ready and bring the requested order and identity information. Please inspect delivered or collected goods promptly and follow the issue-reporting process in the Refund and Cancellation Policy.
8. Cancellations, returns and refunds
Eligibility, procedure, return condition, costs, refund method and expected timing are set out in JTC’s Refund and Cancellation Policy, which forms part of these terms. Separate written terms may apply to bulk, business, customised, installed or specially sourced orders.
9. Warranties and after-sales support
Any product-specific manufacturer or JTC warranty applies only where stated for that product, quotation or invoice. Warranty periods and remedies may differ by brand and product.
Warranty support may require proof of purchase, the product serial or batch information, photographs, inspection and compliance with use and maintenance instructions. A warranty does not cover normal wear, misuse, overloading, accidents, improper storage, unauthorised modification or installation contrary to instructions. Statutory rights remain unaffected.
10. Website accounts and acceptable use
You are responsible for accurate account and order information and for keeping login credentials confidential. Notify JTC if you suspect unauthorised account use.
You must not misuse the website, interfere with its security or operation, submit false or unlawful information, attempt unauthorised access, use automated systems in a way that burdens the service, or copy website content in violation of intellectual-property rights. JTC may restrict access where reasonably necessary to protect customers, the business or the website.
11. Intellectual property and third-party services
Unless stated otherwise, JTC’s website text, layout, graphics, photographs, branding and other original content are owned by or licensed to Joher Trading Company and may not be reproduced commercially without permission.
The website may use or link to independent payment, mapping, social-media, analytics, courier and other services. Their own terms and privacy practices may apply. JTC is not responsible for an independent service outside JTC’s reasonable control, but this does not limit JTC’s responsibility for the goods it sells or rights that cannot lawfully be excluded.
12. Privacy
JTC handles personal information as described in its Privacy Policy. Order information may be shared with payment providers, banks, couriers, transporters, hosting and support providers where necessary to process payment, fulfil the order, prevent fraud, provide support or comply with law.
13. Responsibility and events outside control
JTC does not exclude responsibility for fraud, wilful misconduct, personal injury caused by negligence, a verified failure to supply goods in conformity with applicable standards or warranties, or any other responsibility that cannot lawfully be excluded.
To the extent permitted by law, JTC is not responsible for indirect or consequential business loss arising from ordinary consumer website use. For a business purchase, JTC’s responsibility for a claim is limited to the amount paid for the affected goods, except where a higher responsibility is required by law or expressly accepted in writing.
JTC is not liable for delay or failure caused by events outside its reasonable control, but will take reasonable steps to communicate, mitigate the effect and provide any remedy required by applicable law.
14. Governing law, changes and severability
These terms are governed by the laws of Sri Lanka. The parties should first try to resolve a concern directly and in good faith. Customers retain the right to use any complaint or redress process available under applicable law.
JTC may update these terms for future website use and orders. The version published when an order is accepted applies to that order unless a change is required by law or agreed with the customer.
If part of these terms is found invalid or unenforceable, the remaining terms continue to apply. A delay in enforcing a term is not a waiver of it.
